The roadster situation and the FSD situation are two things where I cannot understand why there hasn't been class action lawsuits about it, especially FSD. I know Tesla owners legitimately no bullshit on their third Tesla and that bitch still can't drive itself or do the shit Elon promised 10 years ago. The smartest thing they possibly did was make it a subscription service option now because it makes people less pissed knowing their FSD payment of like 8 grand doesn't carry over to their next Tesla.

Given he very publicly said "we're making it now" I would have thought it straightforward to get the deposit back. Here in the UK I would be able to use what is known as the small claims procedure. I'd write a letter to Tesla asking for the $5k, saying unless you send it to me within two weeks I will make a civil claim. If they failed to refund it I pay c. $200 to the court, no need for representation, and if they still failed to pay I attend a hearing, and I imagine the court would agree they have to repay the $5k.
If Tesla still refuse to pay after that the next step is to start procedures to have them declared bankrupt. By default, if they fail to pay when a court has ordered them to do so, that is automatic. Tesla would be very foolish to continue to fail to pay at this point. I could probably get expensive lawyers to do all this bit on what is called a conditional fee basis, as whatever happened the money would be paid, plus my costs so I'd be $5k up at the end of it all.
Is it so much more difficult in the US? Maybe Marques cannot be bothered over $5k? Am I missing something? I expect there are some terms and conditions very biased towards Tesla, but unless they explicitly stated words to the effect that Elon's "we're making it now" statement was a lie, and that they reserve the right to fail to make a single car for decades, and the deposits are non-returnable in any case, would a US court really side with Tesla over this?

It’s even worse in the UK where FSD has basically only meant the car will automatically stop at a traffic light. You could have specced it on a lease 5 years ago, paid the full amount on Elon’s promise the release was imminent, and seen zero benefit for the entire lifetime of the lease.

Good question. I think we can be confident that he does not buy the vehicles he reviews. However the Tesla roadster would be completely different. It’s highly controversial and would generate a ton of views. It also might be extremely hard to get a hold of and have a good rehab value so the best way for him to get an early review would be to buy one, or review it, and then potentially sell it.

They'd be write-offs on his taxes but he still has to make enough money that the taxes on them will be big enough so that the write-offs make sense. If you're only paying 50k in taxes and you need to write off 75k in purchases then you are losing 25k since you don't have enough taxes to write off against

Even 8 years ago it should have been obvious that Tesla were going to fail to deliver anything meaningful. And they haven’t since. Cybertruck was “delivered”, but nothing like the product promised, except for the stupid design. The semi truck is a nothing burger. fSD doesn’t exist.
If Marques Brownlee were really a sharp reviewer, he’d have skipped reserving a Roadster because it wasn’t going to be built.
The ONLY thing Tesla and Musk have delivered are insane valuations. There is no Tesla vehicle that is the top of its class. If Marquess Brownlee couldn’t see that, then he is just a reviewer of things out in front of him.

That’s because Elon is still butt hurt for him swapping his cybertruck with a Rivian and instantly unfollowed him on Twitter. I got my issues with MKBHD but he was real on this one, especially after semi glazing him back in 2018 with the plant tour (which ended up being free advertisement for Tesla on top of all the cars he reviewed.) Since he’s back in good graces with Trump he will probably have him investigated.

I mean the Rivian is legitimately just lightyears better than the Cybertruck in every way imo outside of maybe the auto pilot, but I haven't tried Vivian's newest software so I can't comment on that. I've heard as well the Lucid sedan and SUV are fucking lightyears better than the Model S and X. I'm not a rich man to upgrade to those cars as of yet lol. But if they made a 40k to 50k competitor to the model Y I would be very interesting. But Elon would have to be an idiot to not understand why journalists would rather switch over.

You seem to be either looking for reasons to be upset at the guy or you don’t really understand how YouTube videos work.
For his video to be successful, he has to have one of the first reviews of the Tesla Roadster. If that means getting on the waitlist early to be one of the first people who can get them, that’s worth a lot of money to him. Way more than the value of the car.
If you think he could just “rent” one, that demonstrates a huge misunderstanding of how this whole thing works. By the time one of these is available for rent, many other videos will have already been posted. It’s not a realistic option for his profession.
The fact that he’s on the waitlist tells us nothing about whether he wants to own one of these cars. All we know is that he wants to be one of the first to review it. Everything else is speculation.

The Roadster is long dormant and forgotten. It would be hopelessly out of trend if they introduced it. A Tesla ‘supercar’ does not fit the stagnant brand. How they held these deposits for eight years is unethical.

Not sure why Tesla should be sued. Elon said in the past that this is how you sponsor the development of Tesla cars. You are basically an investor. Sometimes it works, sometimes it doesn't. Same with FSD. Anyone fool enough to pay for the FSD is basically sponsoring the company.

There's a hilarious video on YouTube from this guy called bearded Tesla where he talks shit about Tesla detractors in the beginning of the video and he stated he was going to drive from California to Jacksonville, Florida using FSD to prove the haters wrong. Guess what happens during PART 1 of the video at the end? He runs ver an object on the highway that FSD didn't detect and the idiot did not want to disengage FSD for whatever reason to avoid it. They are so far from fully autonomous vehicles it's not even funny. Don't get me wrong as someone with certain anxiety driving sometimes, it feels good to go into FSD and go on a 70 MPH or sometimes 80 MPH road and just have FSD drive me so I can relax. But I used it mainly as an advanced cruise control type of deal.
I think to your main point I think Tesla is just poorly ran. The Model Y honestly was their first just knock it out the park item from start to finish and they followed it up with bullshit robotaxi nonsense, a cybertruck that's worth next to nothing and sells nothing, and a roadster that doesn't exist. They could've easily just kept stacking cash and made a sub compact SUV and a off road vehicle to increase their models and add even more price and vehicle variety to their lineup and Elon just meme'd his way to pumping the stock instead.
