They think rich people should pay the **same** fines. That's the problem. A $15,000 fine would destroy the average worker living paycheck to paycheck. It isn't even a rounding error for Elon Musk. A mosquito bite has more of an effect on his life. But to a conservative judge, making him pay anything more than a cashier or delivery driver would receive as a fine is unequal treatment - and therefore not fair to poor Elon. Penalties that don't hurt the penalized have zero impact on their future behavior. But to the right, that's a feature rather than a bug.

Depends on what you mean by “anything”. The SJ motion addresses only liability, not remedies, which would be briefed separately per the SJ motion. This appears to be based on his failure to make a required filing once he passed a 5% ownership stake. I can’t imagine large penalties for that violation.
