This one is a bit tough to TLDR. u/EV_fan24, aka Cristina Balan, has fought Tesla for ages and this article chronicles her arbitration/court experience.
This situation should be a lesson for every current and future owner of a Tesla EV. If you are dumb enough to buy a vehicle from a company that requires you to participate in this kangaroo court arrangement when seeking a legal remedy, then you deserve what you signed up for.
People do not understand how many services they use, especially with large companies, come with arbitration clauses.
Better consumer laws will prevent these loopholes. In the UK statutory laws does not allow a company’s T&C to unilaterally remove consumers rights.
Ford has adopted a similar arrangement; or they won't sell you a car. I'd say walk away.
It's a bigger deal with Tesla because they're direct sales, there's no dealership, which means if *anyone* went wrong in the process of delivering the car there's no one for you to sue
Ford is a credible company with a good reputation to uphold. Tesla is not..
