Article could have been a paragraph > Rivian filed a motion for the lawsuit to be dismissed, but this was denied by a California judge who tentatively ruled earlier this year that Rivian would have to face a trial. The trial was expected to take place in 2025, but it now looks like the matter may be wrapped up before the end of the year without coming to that.
Settled means one side (or both) did not want to go through Discovery to find the truth. I wonder who settled?
Tesla is about to have a large influence on the government. It's probably not ideal to be in a lawsuit with them right now, so I guess rivian
[removed]
It takes both sides to settle lol
Yes it does. But the intent or request usually comes from one side
Wasn’t one of the pieces of evidence Rivian employees asking hires from Tesla to “bring xyz documents with you because we don’t have anything like that here” Probably not easy to argue your way out of that.
That’s not true at all. A settlement can easily happen after discovery when an attorney now knows all the facts and can effectively advise their client that their case is weaker than originally believed.
In this case in particular
In the attached article discovery isn’t mentioned at all. Seeing as the case is four years old I would assume many depositions have already taken place and a significant amount of discoverable communications have already been shared. It says they were set for trial next year. You don’t set a trial date (even a tentative one) without having completed discovery.
You’re definitely more knowledgeable on the process, I’ll defer to you
Uh have you read any of the news about DoGE?
A better way to put is a trail is a failure the 2 sides to come to an agreement. Think of a trail is a failure settlements are the goals.
Not before voted in and especially not in California courts
Trial.
No, if they go to the trail, only the Rivian makes it back
> usually Well that depends on the judge. There are plenty of case I’ve been involved in that the court exerted plenty of influence to settle despite neither side wishing to do so.
I’ve yet to see this in real life, but thanks for informing me about this as well
I know you might be a “lawyer” or otherwise someone with other law “expertise” but I’ll have you know I watched Suits 6 times, so sit down and let the grownups handle it. He’s guilty your honour.
