“Depending on context of surrounding traffic, yes.” So that could mean if there are no other cars on the road, it is safe.  I guess Musk thinks the corporate puffery defense will continue to protect Tesla.  It will be interesting to see how the other lawsuits go

I see people doing stupid things literally every day because they are on their phones while driving and none of them have FSD vehicles. Blowing through red lights, slowly drifting out of their lanes only to suddenly jerk back into the lane, needing to be honked at because the light changed I wish police would ticket them

Well, his goal is to pump the stock and that has certainly been achieved. He added about 25b$ to TSLA‘s value with this. He needs to sell a lot of FSD licenses to justify that pump.

I wish I could believe that. I’ve lived in too many places where cops don’t give half a shit about cell phone use. Hell, the Macomb County Sheriff in Michigan went on TV once and said something like “We won’t pull anybody over just for using a phone…”

In British Columbia, Canada, [Part 3.1 of the Motor Vehicle Act](https://www.bclaws.gov.bc.ca/civix/document/id/complete/statreg/96318_06#part3.1) makes is clear that using an electronic device is prohibited while "driving or operating a motor vehicle on a highway." "Electronic device" is defined in Part 214.1 and specifically refers to "a hand-held electronic device that is capable of transmitting or receiving electronic mail or other text-based messages," among other definitions. The police are often on the lookout in Greater Vancouver for people texting at stop lights and will happily give out tickets. Use of phones while driving is called "distracted driving," and in BC, if you're caught, you'll get a CDN $368 fine and 4 points. With our point system, if you have four points or more within a 12 month period, you'll also have to pay a driver penalty point premium on your insurance, which works out to about $252. So ... regardless of what fElon says, you'll get a ticket in BC that will end up costing you about $620 ... and that's for the first infraction only. By the way, while this doesn't apply to FSD, the Motor Vehicle Act of BC currently prohibits the operation of Level 3, 4 and 5 self-driving vehicles. Currently, Level 2 self-driving vehicles are allowed in BC, provided the driver is ready to take over at any time.

The thing is, Ford’s documentation and public statements are very clear that _you **are** driving_ even when the Level 2 ADAS is engaged. Ford’s systems will also detect if you’re texting while driving, and potentially shut down the ADAS if you’re not paying sufficient attention. Ford doesn’t want to get sued because someone thought the vehicle would drive itself and caused a crash. The statements by Tesla’s CEO, and changes to the ADAS safety monitoring features both can be considered to _actively encourage_ the driver to engage in distracted driving. If a driver is using the ADAS and their phone at the same time and causes a crash, it isn’t unreasonable to argue that Tesla is partly responsible — the company _said_ it was safe to do, and the ADAS didn’t warn the driver that they were engaging in unsafe behavior. So in a lawsuit situation, Tesla will get dragged into it. Even if they don’t have to pay out a settlement or judgement, it still costs money (that they shouldn’t have to spend) to defend against these suits.
